General
By accessing the website located at www.nztruckdrivingjobs.co.nz, and registering as an Employer, you agree to be bound by these terms and conditions (Employer Terms). Please review them carefully before acceptance.
We may change these Employer Terms at any time for legal or business reasons on 30 days’ notice by updating them on the Website at www.nztruckdrivingjobs.co.nz/employer-terms. By continuing to use the Website you agree to be bound by the changed Employer Terms immediately, to the extent the changes are not detrimental to you, and otherwise from your next purchase, and you are responsible for ensuring you are familiar with the latest Employer Terms.
Definitions
Job Advertisement means an advertisement offering a truck driving job posted by an Employer.
Employer or you means a person who has created an Employer account and profile on the Website as an Employer.
Recruitment Agency or Recruiter means a third-party agency, consultancy, or labour hire company that sources candidates for truck driving jobs, either on behalf of a client or as the direct employer of the candidate.
Fee means the fee we charge to an Employer to post a Job Advertisement in accordance with these Employer Terms.
GST means Goods and Services Tax in accordance with the Goods and Services Tax Act 1985.
Jobseeker means truck drivers who are seeking employment from Employers via the Website.
The Website means the platform provided by us to connect Jobseekers with Employers.
Us or we means NZ Truck Driving Jobs Limited.
Driver Database means the internal database of verified jobseekers maintained by NZ Truck Driving Jobs, also referred to as the Candidate Pool. Only drivers who meet eligibility criteria and complete the Candidate Verification Form (including a licence check) may be included in this database.
Data Protection and Privacy
Protecting your privacy is important to us. Please review our Privacy Policy in order to better understand our commitment to maintaining your privacy as well as our use and disclosure of your information. You agree to us using your personal information as described in our Privacy Policy at www.nztruckdrivingjobs.co.nz/privacy-policy.
While we take reasonable steps to ensure the Website, you acknowledge that internet transmissions are never completely private or secure. You understand that any information you post, send or share using the Website may be read or intercepted by others.
Please note that where we include links on the Website to the applications, website or services of third parties, we are not responsible for the privacy practices of such third parties, or the way they handle any personal information they collect about you. You should ensure you read their privacy policies carefully before using these third party website or services.
As you are also an agency that collects personal information in accordance with privacy and data security laws, we require you to comply with your legal obligations in relation to collection and retention of that information. You agree that you will not use the Website if you are not aware of your legal obligations in this area and cannot confirm you are compliant.
Proprietary Rights and Licence
All trade marks, copyright, database rights, and other intellectual property rights of any nature in the Website together with the underlying software code are owned directly either by us or by our licensors.
We hereby grant you a worldwide, non-exclusive, revocable licence to use the Website for your personal use in accordance with these Employer Terms.
Conditions of Use
The Website comprises an online platform on which Employers can place Advertisements about Employment in New Zealand and Australia and New Zealand licensed truck drivers can seek employment.
By creating an account with us as an Employer you:
- Consent to us conducting verification and security procedures in respect of the information provided during the registration process
- Declare that you are a registered New Zealand or Australian Employer. We will only accept Australian or international employers that offer fly-in fly-out back to New Zealand
- Agree to keep any login and account details confidential and secure
- Confirm that the individual creating the account and posting Advertisements is authorised to do so by the Employer
You confirm that all information and details you provide us are true, accurate and up to date in all respects and at all times. You can update and correct your Employer details at any time via your Employer account.
You will not, nor allow third parties on your behalf to:
- Make and distribute copies of the Website
- Attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange, or translate the Website
- Create derivative works of the Website of any kind whatsoever
We reserve the right to amend or withdraw the Website in accordance with these Employer Terms at any time and for any reason.
You acknowledge that when you form an employment relationship through the Website with a Jobseeker we are acting solely as an intermediary and not as a party to your agreement with that Jobseeker.
As an Employer you agree to compensate and indemnify us against any loss, damage, liability or claims that we suffer or become liable for because of your failure to comply with these Employer Terms.
Availability
We will use reasonable efforts to make the Website available at all times. However, you acknowledge the Website is provided on the internet and on mobile networks, so the quality and availability of the Website may be affected by factors outside our reasonable control.
We and our sub-contractors do not accept any responsibility whatsoever for unavailability of the Website or any difficulty or inability to download or access content or any other communication system failure which may result in the Website being unavailable.
Registration
Employers must complete the account registration process on the Website and be verified by us before Job Advertisements can be posted. We require the following information, which we will verify:
- NZBN
- Primary and secondary contacts
Use of Custom Domain Email
To ensure the legitimacy of employers using our platform, we strongly encourage all Employer accounts to register using a business email address associated with a custom domain (e.g. @yourcompany.co.nz).
If you sign up using a generic email address (e.g. Gmail, Yahoo, Outlook), additional verification steps may be required before your account can be approved. These may include:
- A short video call to confirm your identity
- Providing information about your company (such as number of trucks, freight types, or service areas)
- Sharing a website, social media presence, or other proof of operations
We reserve the right to delay or decline account approval if adequate verification cannot be completed.
On registration, you will be asked to create a password. You must keep your password confidential at all times and use it only to access and use your account and not for any other purpose. You are the only authorised user of your account and, accordingly, you must not disclose your password to anyone else. You should contact us immediately upon discovering any unauthorised use of your account or error in the operation of your password. Any breach of these terms and/or any use of your account by anyone to whom you disclose your password will be treated as if the breach or use had been carried out by you and will not relieve you of your obligations to us.
You must cease to use and delete the password for your account on termination of your account for whatever reason.
Your Employer profile on the Website must be created by you and in accordance with our instructions and any Website specifications. We will verify all your details before we activate your account.
You can choose to receive job applications from registered Jobseekers directly to your account. Otherwise, Jobseekers can apply by email or via a job link.
Additional Conditions for Recruitment Agencies
Recruitment agencies may use the Website to post job listings on behalf of employer clients, provided that:
- Each Job Advertisement must be for a genuine, active role with a real employer who has authorised you to recruit for that vacancy
- Listings must not be speculative, used to build candidate databases, or posted without employer authorisation
- You are responsible for ensuring the role details are accurate and up to date, including location, job title, and employment type
- You agree not to use information obtained through NZ Truck Driving Jobs to send unsolicited offers, promotional content, or to add candidates to mailing lists without their consent
We reserve the right to request proof of employer authorisation for any listing you post. If we determine that a listing breaches these conditions, we may remove the listing or suspend your account.
Where we have a verified candidate whose preferences align with your areas of recruitment, we may provide that candidate with your agency’s contact details so they can reach out directly. We will not share candidate details with you unless you are actively recruiting for a listed role and have passed our verification checks.
You are responsible for complying with all relevant laws relating to recruitment services, privacy, employment advertising, and fair trading.
Job Advertisements
Whether you are a direct employer or a verified recruitment agency, when posting a Job Advertisement you agree to comply with the following rules:
- All employment or contract opportunities must be genuine
- Unpaid work trials or commission only roles are not allowed
- You cannot post multiple roles within a single Job Advertisement
- You must comply with the Fair Trading Act 1986, the Privacy Act 2020, the Human Rights Act 1993 and employment laws including but not limited to minimum wage, fair work conditions and clear employment terms
We reserve the right to reject non-compliant Job Advertisements and terminate your Employer account if you repeatedly breach the above rules.
We offer three types of Job Listings, each with different levels of exposure:
- Basic Listings are standard website placements
- Highlighted Listings include a highlighted placement for increased visibility
- Premium Listings include a highlighted placement and permission for us to promote your role on our main Facebook page and in our private Driver Database group
By purchasing a Premium Listing, you authorise us to use your job listing content (such as the job title, location, and summary) to create promotional posts on social media and in our newsletter.
All Job Listings are automatically included in job alert emails to verified drivers who have opted in to receive updates.
We also offer multi-pack discounts for employers who purchase multiple listings at once. Discounted multi-packs are available in 3, 5, and 12 listing bundles (valid for 12 months from the date of purchase).
We also offer an Annual Membership option, which includes:
- Unlimited Basic Listings
- 5 Highlighted Listings
(valid for 12 months from the date of purchase)
Our Job Advertisement packages (including inclusions and exclusions) and Fees from time to time are as stated on the Website.
Fees listed on the website are in New Zealand dollars and include GST.
Subscriptions are payable in advance either monthly, quarterly, or annually.
Fees listed on the website are to be paid via the Website and Stripe. Where payments are missed, we reserve the right to charge a late payment fee and suspend or cancel your account as we consider appropriate.
If you require an invoice, this can be arranged on request. Where invoice payment is made by credit card, a 2% card processing fee will apply. There are no additional fees for invoice payments made via bank transfer.
Purchases made directly through the Website include GST. However, services arranged separately (such as recruitment support or custom packages) are invoiced and charged excluding GST, with GST added at the time of invoicing.
NZ Truck Driving Jobs Recruitment Services
We also offer recruitment support services outside of standard job listings. These services are tailored to your hiring needs and not available for purchase directly through the Website.
If you engage us for recruitment support or end-to-end recruitment, a formal proposal and service agreement will be provided outlining the scope, process, fees, and terms and conditions specific to that service.
Jobseeker Complaints
As appropriate we will direct Jobseeker complaints to you to resolve and you agree to comply with your obligations under the Consumer Guarantees Act 1993 in relation to those complaints and claims.
If you have a complaint about a Jobseeker you will need to resolve that yourself, directly with the Jobseeker. We are not responsible for addressing or resolving Employer/Jobseeker disputes. Employers are responsible for ensuring that they comply with New Zealand employment laws at all times.
Remedies
If you breach these Employer Terms then (without limiting any other remedy we may have), we may at our sole discretion, disable or partially disable, modify or delete any or all of your accounts, block your IP address or device from accessing the Website, or in any other lawful way partially or fully restrict your access to the Website.
We may terminate your account (including any subscription) at any time on notice by notifying you in writing if we receive a complaint or series of complaints about you or your business, or if we deem your behaviour, your profile or any content that you have provided to be unacceptable.
If we terminate your account for any of these reasons, then we will not provide you with a refund of any Fees paid to us for the current subscription term.
You agree to compensate us and keep us compensated for any loss we suffer (including financial or reputational loss) howsoever arising, as a result of your breach of these Employer Terms.
Even though this agreement may have been terminated by either of us, those rights and responsibilities which are intended to continue after this agreement ends won’t be affected by that termination.
Disclaimer and Liability
The Fair Trading Act 1986 may imply warranties or conditions or impose obligations which cannot be excluded, restricted or modified. These Employer Terms must in all cases be read subject to those statutory provisions.
To the maximum extent permitted by law, and for the avoidance of doubt, we hereby disclaim all implied warranties with regard to the Website. The Website and software are provided "as is" and "as available" without warranty of any kind.
In no event will we be liable for any direct, indirect, special, punitive, exemplary, or consequential losses or damages of whatsoever kind arising out of your use of or access to the Website, including loss of profit or the like whether or not in the contemplation of the parties or whether based on breach of contract, tort (including negligence), product liability, or otherwise.
We are not liable to you for any damage or alteration to your equipment, including but not limited to computer equipment, handheld devices, or mobile telephones, as a result of the installation or use of the Website.
The Website may include links to third party websites. We accept no responsibility for the availability, suitability, reliability or content of such third party websites and we do not necessarily endorse the views expressed in them.
General
We will seek your permission before we republish Job Advertisements or share Employer information on our social media accounts.
Events outside our control: If any cause beyond our reasonable control including but not limited to order of a government or other authority, strike, lockout, labour dispute, delays in transit, difficulty in procuring components or equipment, embargo, accident, emergency, natural event interferes with our performance of any of our obligations under these Employer Terms then we may at our sole discretion suspend our performance of any such obligation or cancel any contract and we will not be liable to you in any respect.
Waiver: These Employer Terms remain in force notwithstanding any neglect, forbearance or delay in enforcement. We will not be deemed to have waived any condition unless such waiver will be in writing and such waiver will only apply to the particular transaction to which it refers.
Severability: If any clause or provision of these Employer Terms will be held illegal or unenforceable by any judgment of any Court or Tribunal having competent jurisdiction, such clause will not apply to this Agreement. The remaining provisions of this Agreement will remain in full force and effect as if the clause or provision held to be illegal or unenforceable had not been included.
Entire agreement: These Employer Terms constitute the entire agreement between you and us and supersede and extinguish all previous discussions, correspondence, negotiations, drafts, agreements, promises, assurances, warranties, representations and understandings between us, whether written or oral, relating to the Website.
Assignment: You acknowledge that we may transfer our rights under these Employer Terms (and any related claims) to any third party without having to obtain your prior consent.
Governing Law and Jurisdiction
These Employer Terms will be governed by the laws of New Zealand. You agree to submit to the non-exclusive jurisdiction of the New Zealand courts.
